1. About These Terms
These terms and conditions govern your use of the Borchard Container Transport Limited website and form the basis of any contract between us for the supply of goods and services. By using our website or engaging our services, you agree to be bound by these terms. 3. Quotations
All quotations provided by Borchard Container Transport Limited are valid for 30 days from the date of issue unless otherwise stated. Quotations are based on the information provided by you at the time of enquiry. Changes to requirements may result in a revised quotation. Quotations do not constitute a binding contract until accepted in writing and accompanied by any required deposit payment.
4. Orders and Payment
A binding contract is formed when you accept our quotation in writing and pay the agreed deposit. Payment terms are specified in the quotation and typically require a deposit to commence work, with the balance payable prior to delivery unless otherwise agreed. We reserve the right to charge interest on overdue payments at the rate of 4% above the Bank of England base rate.
5. Delivery
Delivery dates are estimates provided in good faith. While we make every effort to meet agreed delivery dates, we cannot accept liability for delays caused by circumstances beyond our reasonable control. Delivery is to kerbside at the agreed UK address unless site access arrangements have been confirmed in advance. It is your responsibility to ensure the site is accessible and suitable for delivery.
6. Warranties
New containers carry the manufacturer's standard warranty. Refurbished containers are sold with a structural warranty as specified in your quotation. Conversion work is warrantied for workmanship for a period of 12 months from delivery. Warranty claims are subject to inspection and do not cover damage resulting from misuse, modification, or failure to follow our care and maintenance guidance.
7. Limitation of Liability
Our liability for any claim arising from the supply of goods and services shall be limited to the contract value. We shall not be liable for any indirect, consequential, or special damages. Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
8. Cancellation
For consumers (non-business customers), you have the right to cancel your order within 14 days of placing it under the Consumer Contracts Regulations. For bespoke or custom-made items, this right may be limited. For business customers, cancellation terms are as specified in your contract.
9. Governing Law
These terms and conditions are governed by and construed in accordance with English law. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
